Fastchip’s General Terms and Conditions

These general terms and conditions apply to all offers and agreements made by Fastchip, accessible via fastchip.nl. Please read them carefully before entering into an agreement with us. These terms and conditions were last updated on the date stated above.

 

1. Applicability

1. These general terms and conditions apply to every offer made by Fastchip and to every contract between Fastchip and the customer, unless the parties have expressly agreed otherwise in writing.

2. Before the contract is concluded, Fastchip makes these terms and conditions available via fastchip.nl so that the customer can save them. Any terms and conditions of the customer’s own are rejected.

3. If any provision is void or voidable, the remaining provisions shall remain in force and the parties shall consult to agree on a replacement provision.

 

2. Offer and Formation of the Agreement

1. Any offer made by Fastchip is non-binding, unless a specific time limit for acceptance has been expressly stated. An offer may contain obvious errors or mistakes; Fastchip is not bound by such errors or mistakes.

2. The contract is concluded when the customer accepts the offer and Fastchip confirms that acceptance. In the case of an online order, the customer will receive a confirmation by email.

 

3. Payment

1. Payment must be made within the period stated on the invoice, unless otherwise agreed.

2. If the customer fails to pay on time, they shall be in default once Fastchip has sent them a reminder setting a reasonable deadline. Thereafter, Fastchip is entitled to charge statutory interest and reasonable collection costs, subject to the statutory scale applicable to consumers.

 

4. Liability and force majeure

1. Fastchip’s liability is limited to direct loss and to the amount paid out by the insurance in the relevant case, or, if no payment is made, to the invoice amount of the relevant agreement.

2. This limitation does not apply insofar as the loss results from Fastchip’s wilful misconduct or deliberate recklessness, or insofar as the law prohibits it.

3. In the event of force majeure, Fastchip is entitled to suspend performance. If the force majeure lasts longer than is reasonable, both parties may terminate the contract in respect of the part not yet performed.

 

5. Complaints and disputes

1. If the customer has a complaint, they must report it to Fastchip via This email address is being protected from spambots. You need JavaScript enabled to view it. within a reasonable period after discovery, so that the parties can reach a resolution.

2. If the parties are unable to reach a mutual agreement, the dispute may be submitted to the competent Dutch court or, where applicable, to a recognised disputes committee.

 

6. Governing law

1. These terms and conditions and all agreements with Fastchip are governed exclusively by Dutch law. Mandatory consumer law remains fully applicable.

7. Right of Withdrawal (Cooling-off Period)

  1. For physical products purchased online, consumer buyers have a statutory cooling-off period of 14 days from the date of receipt to withdraw from the contract without giving reasons.

  2. The right of withdrawal explicitly does not apply to:

    • Digital content, software, software licenses, downloadable products, or electronically delivered tuning files.

    • Products produced according to the customer's specific specifications or clearly customized to personal requirements.

8. Delivery and Risk of Loss

  1. Fastchip will execute orders for physical goods with due care.

  2. The risk of damage to or loss of physical products transfers to the customer at the moment the products are delivered to the delivery address provided by the customer, or handed over to a third party designated by the customer.
